ALLGEMEINE GESCHÄFTSBEDINGUNGEN
1 Geltungsbereich
Für die Geschäftsbeziehung zwischen STEINGAST ART und dem Käufer gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Bestellung gültigen Fassung. Abweichende Bedingungen und Vorschriften des Käufers erkennt STEINGAST ART nicht an, es sei denn, STEINGAST ART hätte ausdrücklich schriftlich ihrer Geltung zugestimmt. Durch die Nutzung des Online Shops www.steingast.art und/oder den Abschluss der Bestellung akzeptiert der Kunde die AGB.
2 Vertragsschluss
Die für den Vertragsschluss zur Verfügung stehende Sprache ist Deutsch. Alle Informationen werden jedoch in deutscher und englischer Sprache angeboten.
Jede Bestellung des Kunden stellt ein verbindliches Angebot an uns zum Abschluss eines Kaufvertrages dar. Wenn Sie eine Bestellung bei STEINGAST ART aufgeben, schicken wir Ihnen eine E-Mail, die den Eingang Ihrer Bestellung bei uns bestätigt und deren Einzelheiten anführt (Bestellbestätigung). Ein Kaufvertrag kommt erst dann zu Stande, wenn Sie das bestellte Produkt versandt oder bei uns abgeholt wird. Die Auslieferung der Ware erfolgt nach Zahlungseingang. Produkte, die zur Abholung im Steingast Art Showroom (Yppenplatz 2/13, 1160 Wien) bestellt werden, werden ab Bestelldatum 2 Wochen lang reserviert. Erfolgt keine Abholung in diesem Zeitraum, werden diese wieder dem Bestand zugeführt.
3 Preise und Zahlungsbedingungen
Der Kunde zahlt den Kaufpreis (Bruttopreis inklusive Umsatzsteuer) nach Wahl des Kunden per Sofortüberweisung (Klarna), PayPal, Apple Pay, Debit- und Kreditkarten oder per Banküberweisung vor der Lieferung (Vorauskasse). Der Kaufpreis ist ohne Abzug vor Auslieferung der Ware sofort zur Zahlung fällig.
4 Lieferung
Die Lieferung erfolgt an die vom Kunden angegebene Lieferanschrift.
Die Bestellung ist in der EU versandkostenfrei ab einem Bestellwert von € 100.
Für Bestellungen unter 100€ gilt innerhalb von Österreich eine Versandpauschale von € 5,90 und € 9,90 innerhalb der restlichen EU.
Versandkostenfreie Lieferung gilt nicht für internationalen Versand und Übersee. Der Versand in weitere Länder ist nach schriftlicher Anfrage dennoch möglich. Zusätzliche Zahlungen für Zölle in nicht EU-Ländern, internationalen Bestellungen/Übersee können weder berechnet werden noch sind diese im Preis inkludiert. Für die Verzollung im Bestimmungsland ist der Kunde zuständig.
Wurde eine Versandoption gewählt, erfolgt der Versand des Werkes zu den angegebenen Versandkosten innerhalb der nächsten 7 Werktage. Angaben über die Lieferzeiten sind ungefähre Richtwerte und unverbindlich. Es besteht auch die Möglichkeit, die bestellten Produkte bei STEINGAST ART, Yppenplatz 2/13, 1160 Wien nach Vereinbarung abzuholen.

Die Lieferfrist wird durch Umstände, wie z.B. im Fälle höherer Gewalt, unvorhersehbare Betriebsstörungen, behördliche Eingriffe, Transport- und Verzollungsverzug, Transportschäden um die Dauer der Behinderung verlängert.
Die Ware bleibt bis zur vollständigen Bezahlung des Kaufpreises im Eigentum des Anbieters (Eigentumsvorbehalt). Der Käufer hat die Ware unverzüglich auf Schäden zu überprüfen. Sollten offensichtliche Schäden vorhanden sein und erst nach Annahme bemerkt werden, so hat der Käufer dies uns gegenüber innerhalb einer Frist von 5 Tagen nach Annahme per E-Mail zu melden. Unterlässt der Käufer dies, so ist die Geltendmachung von Mängelrügen für solch offensichtliche Schäden ausgeschlossen.
Wir legen hohen Wert auf kunstsachgerechte und sichere Verpackungsmaterialien. Sollte dennoch ein Kunstwerk beschädigt bei Ihnen ankommen, so bitten wir Sie, dieses beschädigte Paket nach Möglichkeit nicht entgegenzunehmen, den Vorfall direkt fotografisch und schriftlich zu dokumentieren und den zuständigen Versanddienst darauf hinzuweisen. Somit wird die Sache zu einem Versicherungsfall mit dem verantwortlichen Versanddienstleister.
5 Rücktrittsrecht und Rücksendungen
Ist der Kunde Verbraucher im Sinne des Konsumentenschutzgesetzes (KSchG), kann er von einem im Fernabsatz geschlossenen Vertrag oder einer im Fernabsatz abgegebenen Vertragserklärung binnen 14 Werktage ohne Angabe von Gründen in Textform (z.B. Brief, E-Mail) oder auch durch Retournierung der Ware widerrufen. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Ware. Der Widerruf ist zu richten an STEINGAST ART, Yppenplatz 2/13, 1160 Wien, steingastart@gmail.com. Eine Annahmeverweigerung bei Lieferung stellt keine Rücktrittserklärung dar. Vom Widerrufsrecht sind Spezialanfertigungen (zB. auf Kundenwunsche angefertigte Rahmungen) ausgeschlossen.
Im Falle eines Rücktritts findet eine gänzliche Rückerstattung des Kaufpreises nur Zug um Zug gegen Zurückstellung der vom Kunden erhaltenen Waren statt. Bedingung hierfür ist, dass sich die Ware in unbeschädigtem und verkaufsfähigem Zustand befindet sowie in der originalen Schutzverpackung zurückgeschickt wird. Verpackungs- und Versandkosten so wie Nachnahmegebühren werden nicht rückerstattet. Die Kosten des (Rück-)Versandes trägt der Kunde. Schäden an der Ware, die durch unsachgemäße Verpackung bei der Retournierung entstanden sind, werden dem Kunden in Rechnung gestellt.
6 Haftung
STEINGAST ART haftet nur, wenn STEINGAST ART oder einer seiner Erfüllungsgehilfen eine wesentliche Vertragspflicht in einer den Vertragszweck gefährdenden Weise verletzt hat oder der Schaden auf grober Fahrlässigkeit oder Vorsatz von STEINGAST ART oder einer seiner Erfüllungsgehilfen zurückzuführen ist.
Sofern dies nicht grob fahrlässig oder vorsätzlich erfolgt, ist die Haftung von STEINGAST ART auf den Schaden beschränkt, der bei Vertragsschluss vernünftigerweise voraussehbar war.
Die Haftung wegen zugesicherter Beschaffenheiten, bei Personenschäden, sowie aufgrund zwingender gesetzlicher Vorschriften, insbesondere dem Produkthaftungsgesetz, bleibt unberührt.
7 Gewährleistung
Die gesetzliche Gewährleistungsfrist beträgt 2 Jahre ab Erhalt der Ware. In dieser Zeit werden alle Mängel, die der gesetzlichen Gewährleistungspflicht unterliegen, kostenlos behoben.
Ausgenommen von der Gewährleistung sind Schäden, die auf natürlichen Verschleiß, auf unsachgemäßen Gebrauch und auf mangelnde oder falsche Pflege oder Lagerung zurückzuführen sind. Gemälde, Drucke und Fotografien verändern, von Umwelteinflüssen abhängig, ihre Anmutung und Farbigkeit und können ausbleichen. Für diesen unabwendbaren Veränderungsprozess übernimmt STEINGAST ART keine Gewährleistung. Wir setzen zudem einen sachgerechten Umgang mit Werken voraus.
8 Werknutzungsrechte
Mit dem Kauf eines Kunstwerkes erwerben Sie nur das physische Eigentum an dem Kunstwerk. Ohne vorherige Zustimmung der entsprechenden Rechteinhaber werden keinerlei sonstige Nutzungsrechte (e.g. Reproduktion, digitale Verwertung, zur Verfügung stellen als Leihgabe) eingeräumt.
9 Erhebung, Verarbeitung und Nutzung von persönlichen Daten, Mitgliedskonto
Wir weisen darauf hin, dass zur Vereinfachung des Kaufprozesses und zur späteren Vertragsabwicklung die IP-Daten des Anschlussinhabers vom Webshop-Betreiber im Rahmen von Cookies gespeichert werden, ebenso wie Name, Anschrift, E-Mail-Adresse, Telefonnummer und Zahlungsdaten des Käufers. Die vom Kunden zur Verfügung gestellten Daten sind für die Erfüllung des Vertrages oder für die Durchführung vorvertraglicher Maßnahmen erforderlich. Ohne diese Daten können wir den Vertrag nicht abschließen. Eine Datenübermittlung an Dritte findet nicht statt, mit Ausnahme der Übermittlung von Kreditkartendaten an die abwickelnden Bankinstitute/Zahlungsdienstleister zum Zwecke der Abbuchung des Kaufpreises, an das von uns beauftragte Transportunternehmen/Versandunternehmen zur Auslieferung der Ware und an unseren Steuerberater zur Erfüllung unserer steuerrechtlichen Verpflichtungen.
Bei der Eröffnung eines Kundenkontos erheben wir Ihre persönlichen Daten in der dort angegebenen Anzahl von Datenfeldern. Die von Ihnen angegebenen Daten dienen der Vereinfachung Ihrer Auftragsabwicklung. Die Verarbeitung der Daten erfolgt auf der Grundlage von Art. 6 (1) lit. a DSGVO mit Ihrer Einwilligung. Sie können Ihre Einwilligung jederzeit durch Mitteilung an uns (steingastart@gmail.com) widerrufen. Ihr Kundenkonto wird dann gelöscht.

10 Datenverarbeitung im Rahmen des Bewerbungsprozesses als KünstlerIn
Mit der Übermittlung Ihrer Bewerbungsunterlagen (beispielsweise durch Senden des Lebenslaufes und Portfolio per E-Mail) stimmen Sie zu, dass persönliche Daten wie Name, Titel, Adresse, Telefonnummer, Geburtsdatum, Ausbildung, Berufserfahrung und jene Daten und Bilder, die im Anschreiben, im Lebenslauf, im Portfolio oder anderen gesendeten Dokumenten enthalten sind, zum Zweck des Verwahrens, Zusammenführens und Verfügbarmachens von uns verarbeitet werden, um einen effizienten Bewerbungsprozess durchführen zu können (Art 6 Abs 1 lit f DSGVO), sowie auf der Grundlage der Notwendigkeit zur Durchführung vorvertraglicher Maßnahmen (Art 6 Abs 1 lit b DSGVO).
Sie sind nicht dazu verpflichtet, uns Ihre personenbezogenen Daten zur Verfügung zu stellen.
Speicherdauer
Ihre Daten werden von uns für sechs Monate ab dem Zeitpunkt des Abschlusses eines nicht erfolgreichen Bewerbungsprozesses aufbewahrt. Im Anschluss werden Ihre Daten gelöscht. Sollte Ihre Bewerbung erfolgreich sein, werden wir Ihre im Zusammenhang mit dem Bewerbungsprozess erhobenen Daten jedenfalls so lange aufbewahren, wie gesetzliche Aufbewahrungspflichten bestehen oder solang etwaige rechtliche Ansprüche noch nicht verjährt sind.
11 Anwendbares Recht und Gerichtsstand
Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Als Gerichtsstand wird das Handelsgericht Wien vereinbart.
GENERAL TERMS AND CONDITIONS
1 Scope of application
The business relationship between STEINGAST ART and the buyer is exclusively subject to the following General Terms and Conditions in the version valid at the time of the order. STEINGAST ART does not recognize deviating conditions and regulations of the buyer, unless STEINGAST ART has expressly agreed to their validity in writing. By using the online store www.steingast.art and/or completing the order, the customer accepts the GTC.
2 Conclusion of Contract
The language available for the conclusion of the contract is German. However, all information is offered in German and English.
Each order of the customer represents a binding offer to us to conclude a purchase contract. When you place an order with STEINGAST ART, we will send you an e-mail confirming that we have received your order and stating its details (order confirmation). A contract of sale is not concluded until the ordered product is shipped to you or collected from us. The goods will be delivered after receipt of payment. Products ordered for pick-up at the Steingast Art Showroom (Yppenplatz 2/13, 1160 Vienna) will be reserved for 2 weeks from the date of order. If they are not picked up within this period, they will be returned to stock.
3 Prices and terms of payment
The customer pays the purchase price (gross price including VAT) at the customer's option by instant bank transfer (Klarna), PayPal, Apple Pay, debit and credit cards or by bank transfer before delivery (prepayment). The purchase price is due for payment immediately without deduction before delivery of the goods.
4 Delivery
Delivery is made to the delivery address specified by the customer.
The order is free of shipping costs in the EU from an order value of € 100.
For orders under € 100, a flat shipping rate of € 5.90 applies within Austria and € 9.90 within the rest of the EU.
Free shipping does not apply to international shipping and overseas. Shipping to other countries is still possible after written request. Additional payments for customs duties in non-EU countries, international orders/overseas can neither be charged nor are they included in the price. The customer is responsible for customs clearance in the country of destination.
If a shipping option has been selected, the work will be shipped within the next 7 business days at the shipping costs indicated. Information about delivery times are approximate and non-binding. It is also possible to pick up the ordered products at STEINGAST ART, Yppenplatz 2/13, 1160 Vienna by appointment.

- International shipping/overseas individual delivery offers and delivery time of approx. 2-6 weeks.
The delivery period is extended by circumstances such as force majeure, unforeseeable operational disruptions, official interventions, transport and customs clearance delays, transport damage for the duration of the hindrance.
The goods remain the property of the supplier until full payment of the purchase price (retention of title). The buyer must immediately inspect the goods for damage. If there are obvious damages which are only noticed after acceptance, the buyer must report this to us within a period of 5 days after acceptance by e-mail. If the buyer fails to do so, the assertion of claims for such obvious damage is excluded.
We attach great importance to art-appropriate and safe packaging materials. Should a work of art nevertheless arrive damaged, we ask you, if possible, not to accept this damaged package and document the incident directly photographically and in writing and inform the responsible shipping service. Thus, the matter becomes an insurance case with the responsible delivery company.
5 Right of withdrawal and returns
If the customer is a consumer in the sense of the “Konsumentenschutzgesetz (KSchG)”, he can withdraw from a contract concluded in distance selling or a contract declaration made in distance selling within 14 working days without giving reasons in writing (e.g. letter, e-mail) or also by returning the goods. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation has to be addressed to STEINGAST ART, Yppenplatz 2/13, 1160 Vienna, steingastart@gmail.com. A refusal of acceptance upon delivery does not constitute a declaration of withdrawal. Special productions (e.g. framings made on customer's request) are excluded from the right of withdrawal.
In the event of a withdrawal, a full refund of the purchase price will only be made concurrently with the return of the goods received from the customer. The condition for this is that the goods are in undamaged and saleable condition and are returned in the original protective packaging. Packaging and shipping costs as well as cash on delivery charges will not be refunded. The costs of the (return) shipment shall be borne by the customer. Damage to the goods caused by improper packaging during return will be charged to the customer.
6 Liability
STEINGAST ART is only liable if STEINGAST ART or one of its vicarious agents has violated an essential contractual obligation in a way that endangers the purpose of the contract or if the damage is due to gross negligence or intent on the part of STEINGAST ART or one of its vicarious agents.
If this is not due to gross negligence or intent, STEINGAST ART liability is limited to the damage that was reasonably foreseeable at the time of the conclusion of the contract.
Liability due to warranted qualities, in case of personal injury, as well as due to mandatory statutory provisions, in particular the “Produkthaftungsgesetz“, remains unaffected.
7 Warranty
The statutory warranty period is 2 years from receipt of the goods. During this period, all defects subject to the statutory warranty will be repaired free of charge.
Excluded from the warranty are damages that are due to natural wear and tear, improper use and lack of or improper care or storage. Paintings, prints and photographs change, depending on environmental influences, their appearance and color and may fade. STEINGAST ART does not assume any warranty for this unavoidable process of change. We also assume proper handling of works.
8 Rights of use
With the purchase of a work of art you only acquire the physical ownership of the work of art. No other rights of use (e.g. reproduction, digital exploitation, making available as a loan) are granted without the prior consent of the relevant rights holders.
9 Collection, processing and use of personal data, membership account
We would like to point out that in order to simplify the purchase process and for subsequent contract processing, the IP data of the connection owner is stored by the web store operator in the context of cookies, as are the name, address, e-mail address, telephone number and payment data of the purchaser. The data provided by the customer is required for the fulfillment of the contract or for the implementation of pre-contractual measures. Without this data we cannot conclude the contract. No data is transmitted to third parties, with the exception of the transmission of credit card data to the processing banking institutions/payment service providers for the purpose of debiting the purchase price, to the transport company/shipping company commissioned by us for the delivery of the goods and to our tax advisor for the fulfillment of our tax obligations.
When opening a customer account, we collect your personal data in the number of data fields indicated there. The data you provide is used to simplify your order processing. The processing of the data is based on Art. 6 (1) lit. a DSGVO with your consent. You can revoke your consent at any time by notifying us (steingastart@gmail.com). Your customer account will then be deleted.

10 Data processing in the context of the application process as an artist
By submitting your application documents (for example, by sending the resume and portfolio by e-mail), you agree that personal data such as name, title, address, telephone number, date of birth, education, work experience and those data and images that are in the cover letter, resume, in the portfolio or other documents sent, are processed by us for the purpose of safekeeping, merging and making available in order to be able to carry out an efficient application process (Art 6 para 1 lit f DSGVO), as well as on the basis of the need to carry out pre-contractual measures (Art 6 para 1 lit b DSGVO).
You are not obliged to provide us with your personal data.
Storage period
Your data will be stored by us for six months from the date of completion of an unsuccessful application process. Subsequently, your data will be deleted. If your application is successful, we will keep your data collected in connection with the application process in any case for as long as there are legal retention obligations or as long as any legal claims are not yet time-barred.
11 Applicable law and place of jurisdiction
Austrian law shall apply with the exclusion of the UN Convention on Contracts for the International Sale of Goods. It is agreed that the place of jurisdiction shall be the Commercial Court of Vienna (Handelsgericht Wien).
